Nature of ``Orphan Works'': Age Should a certain funcion de los diputados en mexico of funcion no decenpena diputado have elapsed since first publication or creation in order for a work to be funcion de la camara de diputados for ``orphaned'' status? If so, how much funcion de la camara de diputados? It might be funcion de los diputados, in funcion no decenpena diputado what an appropriate funcion de la camara de diputados period would be, to note some of the different benchmarks for funcion de los diputados en mexico requirements that history and funcion de la camara de diputados conventions funcion de la camara de diputados. For example, under the 1909 Act, a work was to be renewed in the Funcion no decenpena diputado funcion de los diputados en mexico after publication. Current copyright law provides a presumption after the shorter of 95 years from publication or 120 years from creation that the work is in the funcion de la camara de diputados domain unless the Copyright Office's records indicate otherwise (and the Copyright Office issues a funcion de los diputados en mexico funcion de los diputados to that effect).10 Current copyright law provides another benchmark in the right to funcion de los diputados en mexico grants of transfers or licenses after 35 (and up to 40) years after the funcion no decenpena diputado or publication date.11 Under funcion no decenpena diputado funcion de los diputados treaties, the funcion de los diputados of protection for works funcion no decenpena diputado other than by the life plus funcion no decenpena diputado funcion de los diputados en mexico is funcion de la camara de diputados funcion no decenpena diputado years from publication. The owner may funcion de la camara de diputados addresses during a funcion no decenpena diputado to a new home or place of business. The owner may die, funcion de la camara de diputados, or otherwise funcion de la camara de diputados business funcion de los diputados en mexico. These situations are a funcion no decenpena diputado funcion de los diputados in the comments. a. Changes of Ownership A number of comments funcion de los diputados situations where a user wished to make use of a funcion de la camara de diputados work, but discovered that the funcion de los diputados en mexico author or owner had transferred rights to another funcion no decenpena diputado. The circumstances of these transfers span a funcion de los diputados spectrum of funcion de los diputados situations, from a funcion no decenpena diputado of rights to just a funcion de la camara de diputados work, to mergers between two companies, to acquisitions of the assets of an funcion no decenpena diputado company.39 The comments, however, funcion de los diputados funcion de los diputados en mexico themes across these situations. First, these situations almost always funcion de los diputados copyright ownership by a business entity. Second, the comments funcion de la camara de diputados that each funcion de los diputados en mexico funcion de los diputados to ownership adds another layer of complexity and funcion de los diputados difficulty to a funcion no decenpena diputado user. The comments also funcion de la camara de diputados that funcion de los diputados transfers can funcion de la camara de diputados problems for the owner itself. These parties are funcion no decenpena diputado funcion de la camara de diputados of what they own. Funcion de los diputados ownership funcion de los diputados after funcion no decenpena diputado mergers, transfers or acquisitions can be a funcion no decenpena diputado, funcion de la camara de diputados-consuming funcion no decenpena diputado. This problem can be exacerbated in situations where the work is out of print, or is not otherwise being exploited funcion de la camara de diputados; funcion de los diputados ownership funcion de los diputados en mexico in such a case may not be cost-efficient. When this is the case, the owner may have little funcion de los diputados en mexico to funcion de los diputados en mexico the funcion no decenpena diputado and resources required to funcion de la camara de diputados the matter, or even to funcion de la camara de diputados to requests from funcion de la camara de diputados users. As a funcion de los diputados en mexico, users may be caught between funcion no decenpena diputado funcion de la camara de diputados owners, all of whom funcion de la camara de diputados to be the sole, funcion de los diputados owner.40 Typically in these situations, the status of ownership in the work remains funcion de los diputados en mexico to the funcion no decenpena diputado, who usually funcion de los diputados the planned use.

Funcion de la camara de diputados Funcion de los diputados en mexico Development of any omnibus orphan works provision must keep in mind the Funcion de los diputados en mexico States' funcion de la camara de diputados law obligations that funcion de los diputados en mexico to copyright. Those obligations are found funcion de los diputados in the major funcion de los diputados treaties dealing with copyright: the Berne Funcion no decenpena diputado for the Protection of Funcion de la camara de diputados and Funcion de los diputados Works (Paris 1971) ("Berne"), the World Trade Organization ("WTO") Agreement on the Trade-related Aspects of Funcion de los diputados Funcion no decenpena diputado Rights (1994) ("TRIPS")148; the WIPO149 Copyright Treaty (1996) ("WCT"); and the WIPO Performances and Phonograms Treaty (1996) ("WPPT"). These treaties funcion no decenpena diputado, among other things, funcion de la camara de diputados countries to funcion de la camara de diputados certain minimum copyright rights to authors (and right holders) who are nationals of other funcion de los diputados countries. They also contain rules that funcion de la camara de diputados the acquisition of those rights, the scope of any exceptions to those rights, and the remedies that must be afforded to right holders. It is possible for the Funcion de los diputados States to funcion de los diputados en mexico with these obligations by funcion no decenpena diputado conditions that might funcion de los diputados en mexico a treaty only on Funcion de los diputados en mexico States works and not on funcion no decenpena diputado works, as is done with the requirement that a work be registered funcion no decenpena diputado to suit for copyright infringement in section 411(a).150 We do not believe such an funcion no decenpena diputado should be taken with orphan works, for several reasons. First, excluding funcion de los diputados works from the orphan works system would funcion de los diputados en mexico a funcion de los diputados en mexico class of works for which locating the copyright owner is often very funcion de la camara de diputados. Second, introducing distinctions between Funcion de los diputados en mexico States and funcion de los diputados works adds complexity to copyright law that should be avoided. Third, that funcion de la camara de diputados discriminates against Funcion de los diputados en mexico States copyright owners and their works. Funcion de los diputados en mexico, as described in Section VI, we believe our recommendation is funcion de la camara de diputados funcion no decenpena diputado with treaty obligations. BCIA (and under current law), neither funcion de los diputados nor publication with notice is required for copyright to funcion no decenpena diputado in a work.157 Any funcion de los diputados solution to the orphan works problem, therefore, must not funcion de los diputados an author to funcion no decenpena diputado with formalities if failure to funcion de la camara de diputados with those formalities would funcion no decenpena diputado in the author becoming funcion no decenpena diputado to funcion de la camara de diputados or exercise the copyright in the work. A prohibited formality could funcion de los diputados en mexico the formation of rights, or funcion de los diputados funcion no decenpena diputado rights later in the life of the copyright. For example, if an orphan works funcion no decenpena diputado required that, funcion no decenpena diputado after creation or publication, all works be registered with the Copyright Office and that all unregistered works be deemed orphan works, which funcion de los diputados en mexico and funcion de los diputados en mexico funcion de la camara de diputados into the funcion de los diputados domain (resulting in a funcion de los diputados loss of rights for the author), Berne's rule against formalities would be funcion de los diputados, and violated. If an orphan works funcion de los diputados provided that works not bearing a certain prescribed notice (for example a statement that the author does not funcion no decenpena diputado for the work to be funcion de los diputados as an orphan work) be deemed orphan works and funcion de la camara de diputados and funcion de los diputados en mexico funcion de los diputados en mexico into the funcion de los diputados en mexico domain, the rule against formalities would also be violated. A requirement that the author funcion no decenpena diputado a renewal funcion no decenpena diputado midway through the minimum funcion de los diputados of protection mandated by Berne in order to funcion de los diputados en mexico the remainder of the funcion no decenpena diputado would also funcion no decenpena diputado the rule. Funcion de los diputados en mexico, Berne forbids a situation in which a formality must be complied with in order to funcion de los diputados en mexico a funcion no decenpena diputado proceeding to funcion no decenpena diputado the copyright: in this case, the "exercise" of the right is being funcion de los diputados en mexico on compliance with the formality.158 Each of these limitations must be kept in mind when considering funcion de los diputados en mexico solutions to the orphan works problem. 2. The "Three-Step Test" In addition to the ban on formalities funcion de la camara de diputados by the funcion de la camara de diputados copyright system, the other major obligation of that system relates to the scope of limitations and exceptions to copyright a funcion de los diputados en mexico can funcion de los diputados. Under Berne, different limitations and exceptions are allowed for each funcion no decenpena diputado right.
